These Terms and Conditions (“Terms”) constitute a legally binding agreement between you and 420 Pharma. Please read them carefully before using our website or placing an order.

1. Scope of Application

These Terms govern all use of the website https://420pharma.org and all orders placed through our online shop.

They apply to the relationship between 420 Pharma (referred to as “we”, “us”, or “the Company”) and you as the customer.

2. Age Requirement & Eligibility

Our products and services are intended exclusively for adults aged 18 years and older.

By using this website or placing an order, you confirm and warrant that:

  • You are at least 18 years of age
  • You are legally permitted to purchase, possess, and consume cannabis and THC-containing products in your country or region of residence
  • You will not allow any person under 18 to access your account or purchased products
  • All information you provide is accurate, complete, and truthful

We reserve the right to refuse service, terminate accounts, or cancel orders if we suspect a violation of the age requirement.

We may request age verification (including government-issued photo ID) at any stage of the ordering process.

3. Contract Conclusion

Your order placed through our website constitutes a binding offer to purchase selected products.

A contract between you and 420 Pharma is only concluded upon our express acceptance, confirmed via order confirmation email.

We reserve the right to reject orders without providing reasons, particularly in cases of suspected fraud, misuse, or product unavailability.

4. Prices, Payment & Billing

  • All prices are listed in Euros (€) and include applicable Dutch VAT
  • Additional costs (shipping to your country) are shown separately at checkout
  • Payment is due immediately upon ordering
  • We accept the payment methods displayed during checkout
  • You agree to provide accurate billing information and authorize payment processing

5. Delivery & Shipping

We ship all orders in discreet, neutral packaging.

  • Delivery times are estimates only and not guaranteed
  • We are not responsible for delays caused by carriers, customs, or external events
  • You are responsible for import duties, taxes, and customs compliance in your country
  • Risk of loss or damage transfers to you once the goods are handed to the carrier

6. Right of Withdrawal & Returns

You generally have the statutory right to withdraw from your contract within 14 days of receiving goods.

However, the right of withdrawal is excluded for:

  • Sealed products unsealed after delivery for health protection or hygiene reasons
  • Perishable goods (including flowers, edibles, vapes, and cannabis products with limited shelf life)
  • Products that have been opened, used, or modified after delivery

7. Warranty & Product Liability

All products are sold “as is” and “with all faults” to the maximum extent permitted by law.

We disclaim all warranties, express or implied.

You are solely responsible for:

  • Proper storage and handling of products
  • Correct usage and dosage
  • Avoiding harmful combinations with other substances
  • Following all product labeling instructions

We are not liable for any adverse effects, damages, or losses resulting from misuse or improper handling.

8. Limitation of Liability

To the fullest extent permitted by law, 420 Pharma shall not be liable for:

  • Indirect or consequential damages
  • Loss of profits, data, or goodwill
  • Any damages arising from product use or website access

Our total liability shall not exceed the total amount paid by you for the order in question.

9. Customer Responsibility & Legal Compliance

You are fully responsible for ensuring that:

  • Purchase
  • Importation
  • Possession
  • Use of products

complies with all applicable laws in your jurisdiction.

We operate under Dutch law and do not guarantee legality outside the Netherlands.

10. Intellectual Property

All content on this website—including text, images, logos, and product descriptions—is the property of 420 Pharma or its licensors.

Unauthorized use, copying, or distribution is strictly prohibited.

11. Governing Law & Jurisdiction

These Terms are governed by the laws of the Netherlands.

Any disputes shall be subject to the exclusive jurisdiction of the courts in Amsterdam, unless mandatory consumer protection laws state otherwise.

12. Severability & Changes

If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in full force.

We reserve the right to modify these Terms at any time. Continued use of the website constitutes acceptance of the updated Terms.
